New Danish Health Act replaces the National Health Service Act

On 1 January 2007, the Danish National Health Service Act was repealed and instead the new Danish Health Act entered into force. The Health Act gathers and carries on the provisions of a number of acts within the healthcare sector. Apart from the National Health Security Act, some of the acts concerned are the Patients’ Rights Act (lov om patienters retsstilling), the Act on Dental Care (lov om tandpleje) and the Danish Hospital Act (lov om sygehusvæsenet).

The provisions of the National Health Service Act concerning reimbursement and the Medicine Profile can now be found in the Danish Health Act, chapter 42, sections 143-157 .

Simultaneously with the entry into force of the new Health Act (Act no. 546 of 24 June 2005 ) on 1 January 2007 , an amendment of the said act also entered into force. With this amendment ( Act no. 1556 of 20 December 2006 ), the following changes were made relative to reimbursement, the Central Reimbursement Register (CTR) and the Medicine Profile:

  • change of amount limits for reimbursement
  • change of the rules for establishment of reimbursement price of medicinal products with a b-price (fixation of a reimbursement price during the remaining part of a reimbursement period)
  • authorisation to establish rules on obligation to report information about municipal health supplements to the CTR
  • authority to register prescription information in the Medicine Profile (prescription server)
  • authority for municipal home nursing arrangements to have access to the Medicine Profile
  • authorisation to establish rules on dentists’ access to the Medicine Profile
  • authorisation to establish rules on the National Board of Health’s access to the Medicine Profile.
